Judicial colloquium on international commercial arbitration organized

The Judicial Training, Research and Information Academy (JTRII), in cooperation with the Commercial Law Development Program (CLDP) of the U.S. Department of Commerce, the Asian Development Bank (ADB), and the Mongolian International Arbitration Center (MIAC), jointly organized the “Judicial Colloquium on International Commercial Arbitration” on June 19, 2026.
The event commenced with opening remarks delivered by Dr. D. Erdenechimeg, Director of the JTRII; Ms. Grishma Pradhan, Senior Attorney-Advisor for the Commercial Law Development Program; Ms. Maria Cecilia Sicangco, Counsel Law and Policy Reform for ADB; and Ms. S. Enkhtsetseg, Chairperson of the Mongolian International Arbitration Center under the Mongolian National Chamber of Commerce and Industry.

During the first session, themed "Courts and Arbitration," international and domestic experts presented on the following topics:
- Tomoko Ishikawa (Professor at Nagoya University, Japan): “Key consideration in international commercial arbitration”
- Elizabeth Stong (Judge at the U.S. Bankruptcy Court for the Eastern District of New York): “Recognition and Enforcement of Arbitral Awards: The U.S. Experience”
- Kim Young-seok (Judge at the Changwon District Court, Republic of Korea): “The Korean approach to arbitration-friendly courts and the economic case for judicial restraint”
- Bayar Sharav (Legal Counsel at CMS Zurich): “The Role of Court in Advancing effective business dispute resolution through arbitration”
The second session, held under the theme "Arbitration in Mongolia," addressed the current state of domestic judicial practice:
- Dr. M. Suvd (Associate Professor at the School of Law, Otgontenger University): “The legal framework for setting aside domestic arbitral awards and current practice”
- S. Enkhtsetseg (Chairperson of the Mongolian International Arbitration Center under the MNCCI): “The legal framework for recognition and enforcement of arbitral awards and current practice in Mongolia”
- D. Nyambazar (Chief Judge of the Capital City Civil Appeals Court): “Appellate Court Review of Arbitration cases and Grounds for setting aside arbitral awards”
- S. Enkhbayar (Judge of the Capital City Civil Appeals Court): “The role of the Appellate Court in Arbitration proceedings”
Participants engaged in extensive discussions regarding the Mongolian arbitration system, judicial involvement in supporting it, the integration of international standards into the domestic legal environment, and the judicial support and challenges faced in enforcing arbitral awards. In conclusion, the parties mutually agreed on the importance of organizing this type of event, training, and colloquium on a regular basis.
The colloquium was attended by judges of the Capital City Civil Appeals Court, arbitrators of the Mongolian International Arbitration Center, foreign guest speakers, and researchers from the Judicial Academy.
